US Court Mandates Freedom of Abrego Garcia from Immigration Custody
A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment is without lawful basis.
"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her ruling.
The situation originates in a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an error. After his return to the United States to answer human smuggling charges, he was held in federal custody.
In her order, the judge pointed out that the authorities lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
